DCS, Esq. Participates in Support Call- "Achieving a Fair Settlement in Divorce"

On April 16, 2014, Diana C. Schimmel, Esquire participated in a free support phone call sponsored by the Main Line Family Law Center on the topic of achieving a "fair" divorce settlement. The call was a part of the mediation group's monthly seires and was moderated by Adina laver, divorce coach and founder of Divorce Essentials. Diana and attorney/mediator Cris Pastore spent the 50-minute call addressing the following topics from their legal and mediation-minded perspectives:

What does Fair mean? Participant responses vs. Legal definition What happens when they are not aligned?

What are biggest barriers to "fair?"

What is process of fair in mediation?

  • How a couple can negotiate this with the help of a mediator
  • Any misconceptions that could get in the way
  • How they get resolved

What is process of fair in litigation

  • Process - How is this achieved
  • When two attorneys know each other
  • What to do when fear being intimidated

Examples of what it takes to get there in each case.

Registrants were asked at sign up to provide their own perceived definition of "fair." Answers ranged from "50/50" to "Just something I can be comfortable with" to "I'm not sure because I never thought I'd be in this position."

The dynamic between Cris and Diana allowed listeners to hear both the mediation and legal perspectives, but also how the two areas overlap. The call was designed to spark thought provoking preparation for those going through or about to go through the divorce process and educate them on the resources available. A concurrent theme that both Diana and Cris encouraged was to be reasonable and create a supportive team around you. Also, to expect perhaps not the perfect settlement but one you can be ok living with.
